Introduction
This is Futballer. The #1 Youth Sports Soccer App. Welcome to our app. By accessing or using our services and products, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Use (the “Agreement”). Please review this Agreement carefully. If you do not agree to any of the terms set forth herein, you are prohibited from using our website, applications, or any associated products and services.
FutBaller, LLC. and its licensors own and operate these services and products, which are protected under the copyright laws of the United States and applicable international treaties.
Purpose
Futballer is a mobile application designed to provide users with access to youth and academy soccer content in the United States. The app offers features such as live scores, match highlights, player and team statistics, league standings, and a personalized user profile. Users can also engage with a social-style content feed, upload soccer-related media, and share their profiles for recruiting or social engagement purposes. Futballer is intended for use by youth soccer players, their families, coaches, and fans.
The core purpose of FutBaller is to create a safe, monitored environment where youth soccer players, their families, and their teams can record, verify, and share authentic player statistics and achievements. Through our mobile applications and web platform, we facilitate the collection and verification of game data, enable moderated video sharing and community interaction, and maintain statistical accuracy through a structured parent participation system. All features are designed with youth safety as the paramount concern, incorporating strict content moderation and parental oversight for users under 13 years of age.
Your Agreement with Us
To provide the best possible experience for all users, we need everyone to follow the same rules. By creating an account or using any part of FutBaller's services, you acknowledge that you have read, understood, and agree to follow:
These Terms of Use
These documents work together to create the complete agreement between you and Futballer LLC. We refer to our website, mobile applications, premium services, and all related features collectively as "FutBaller" or the "Services."
You must accept these terms in their entirety to register for or use FutBaller. If you don't agree with any part of these terms, you should not use our Services. This is especially important because FutBaller is designed for youth athletes, and these terms help ensure everyone's safety and positive experience.
If you are using Futballer on behalf of a company or other legal entity, you are nevertheless individually bound by this Agreement even if your company has a separate Agreement with us. If you do not want to register an account and become a Futballer Member, do not enter into this Agreement, do NOT click “Join Now”, or “Sign Up Now”, or “Sign Up” or “Register” or “Register Now” and do not access, view, download or otherwise use any Futballer webpage, information or services.
Every time you access FutBaller, you reaffirm your acceptance of the current version of these terms. We recommend reviewing them periodically, as they may be updated to reflect new features or requirements.
Applicable Laws and this Agreement
You must comply with all applicable laws and this Agreement, as may be amended from time to time with or without advance notice, and the policies and processes explained in the following sections:
FutBaller Community Guidelines
License and Warranty for Your Submissions
You own the information you provide FutBaller under this Agreement, and may request its deletion/removal at any time, unless you have shared information or content with others and they have not deleted it, or it was copied or stored by other Users. Additionally, you grant FutBaller a nonexclusive, irrevocable, worldwide, perpetual, unlimited, assignable, sublicensable, fully paid up and royalty-free right to use, copy, prepare derivative works of, improve, distribute, publish, remove, retain, add, process, analyze, use and commercialize any information you provide in any way now known or in the future discovered, any information you provide, directly or indirectly to Futballer, including, but not limited to, any User generated content, ideas, concepts, techniques and/or data to the services, you submit to Futballer, without any further consent, notice and/or compensation to you or to any third parties. Any information you submit to us is at your own risk of loss.
By providing information to us, you represent and warrant that you are entitled to submit the information and that the information is accurate, not confidential, and not in violation of any contractual restrictions or other third party rights. It is your responsibility to keep your personal information on Futballer accurate and updated.
Service Eligibility
To use FutBaller, you must meet certain eligibility requirements. If you are 13 years or older, you can create your own account. For users under 13, a parent or legal guardian must create and manage the account on your behalf. We take youth protection seriously, and these age requirements align with federal privacy laws.
When you register for FutBaller, you confirm that you aren't restricted from using our services, aren't a competitor, and will provide accurate, truthful information about yourself. You'll need to supply your own device and internet access to use our services. We trust you to respect our intellectual property rights and those of others using our platform.
Youth Protection and Parental Controls
The safety of young athletes is our top priority. Parents and guardians play a crucial role in maintaining this safety. For users under 13, parents must not only create the account but also actively manage their child's presence on FutBaller. This includes monitoring activity, approving profile settings, and controlling what information is shared.
We notify parents of account activity and provide comprehensive controls over their child's profile. Parents can review and modify privacy settings, control video sharing permissions, and manage interaction capabilities at any time. When a user reaches 13, their account can be transitioned to a regular account, though parental oversight options remain available.
Content Guidelines
All content on FutBaller must meet our community standards, with particular attention to being appropriate for young athletes. Videos uploaded to the platform undergo review by both AI systems and human moderators before being posted. We strictly prohibit inappropriate language, behavior, or content that doesn't align with youth sports values.
Users may only post content they've created or have the right to share. This includes being mindful of music rights in video backgrounds. Our moderation team reserves the right to remove content that violates our guidelines. These standards help maintain a positive, encouraging environment for youth soccer development.
Account Security
Protecting your account is both your responsibility and ours. You must keep your password secure and confidential, never sharing your account credentials with others. Each user should maintain their own unique account – sharing accounts or creating accounts for others without proper authorization isn't permitted.
We encourage you to enable recommended security features and promptly report any security concerns. If you notice any unauthorized access or suspicious activity, please contact us immediately. These measures help protect not just your account, but our entire community.
Pro Features
FutBaller offers both free and premium services. For our paid features, including ad-free experience and training courses, we process payments through secure third-party providers. We maintain clear records of subscriptions and payments for legal compliance, though we never store complete payment card information.
When you purchase pro features, you agree to pay the specified fees when they become due. Pro features expire immediately upon account cancellation, and we generally don't offer refunds for unused portions of subscriptions. We may change our prices with advance notice to our users.
Statistics and Data Accuracy
FutBaller's statistical tracking system relies on active participation from parents, coaches, and the soccer community. While we strive for accuracy in all game statistics and performance data, we depend on input from those present at matches. We maintain systems for verifying information and correcting any inaccuracies.
Users can submit corrections through our structured ticketing system, which helps maintain data integrity. We reserve the right to verify and modify statistical information to ensure accuracy. However, all game statistics should be considered informational, and we encourage users to maintain their own records as well.
Service Eligibility
To be eligible to use the Service, you must meet the following criteria and represent and warrant that you:
Are the "Minimum Age" (defined below) or older
Are not currently restricted from the Services, or not otherwise prohibited from having a FutBaller account
Are not a competitor of FutBaller or are not using the Services for reasons that are in competition with FutBaller
Will provide accurate information to FutBaller
Have full power and authority to enter into this Agreement and doing so will not violate any other Agreement to which you are a party
Will not violate any rights of FutBaller or third party, including intellectual property rights such as copyright or trademark rights
Agree to provide at your cost all equipment, software, mobile access, and internet access necessary to use the Services
"Minimum Age" means 13 years old for Users who are based in or are citizens of the United States of America (Children's Online Privacy Protection Rule, COPPA) or who are based outside the European Region. "Minimum Age" means 16 years old for Users who are based in the European Union (General Data Protection Regulation, GDPR).
Minors under the "Minimum Age" can still use our services and products by having their parent or legal guardian sign up for a "Minor-Parent" Account also referred to as "Parent Supervision Account" or "Parent Account". Signing up for a Parent Account means the parent or legal guardian will enter this agreement on behalf of their child and will take full responsibility for all the user's information shared on FutBaller.
Using a Parent Account will also help you monitor User-to-User communication which we highly recommend and help with by notifying you about your child's activity via email or other means of communication. We offer an option to transform an account with parent supervision to a normal account in case your child has reached "Minimum Age".
Your Membership
The profile you create and the videos you upload on FutBaller will become part of FutBaller and, except for the information that you license to us, is owned by FutBaller. However, between you and others, your account belongs to you.
You agree to:
Keep your password secure and confidential
Not permit others to use your account
Not use others' accounts
Not sell, trade, or transfer your FutBaller account to another party
Not charge anyone for access to any portion of FutBaller, or any information therein
Further, you are responsible for anything that happens through your account until you terminate your account or prove that your account security was compromised due to no fault of your own. To close your account, please visit your account settings "Deactivate".
Indemnification
You agree to indemnify us and hold us harmless for all damages, losses and costs (including, but not limited to, reasonable attorneys' fees and costs) related to all third party claims, charges, and investigations, caused by:
Your failure to comply with this Agreement
Any content you submit to the Services
Any activity in which you engage on or through FutBaller
Payment
If you purchase any services that we offer for a fee, either on a one-time or subscription basis ("Premium Services"), you agree to FutBaller storing your payment information. You also agree to pay the applicable fees for the Premium Services (including, without limitation, periodic fees for premium accounts) as they become due plus all related taxes, and to reimburse us for all collection costs and interest for any overdue amounts.
Failure to pay may result in the termination of your subscription. Your obligation to pay fees continues through the end of the subscription period during which you cancel your subscription. All applicable taxes are calculated based on the billing information you provide us at the time of purchase.
You may cancel or suspend your Premium Services from your account settings. FutBaller does not offer refunds on any fees and charges related to Premium services you enroll in, including partially used periods. Please note that all premium features expire immediately after you cancel/deactivate your account, so make sure you use all your credits before deciding to cancel.
Notify us of Acts Contrary to the Agreement
If you believe that you are entitled or obligated to act contrary to this Agreement under any mandatory law, you agree to provide us with detailed and substantiated explanation of your reasons in writing at least 30 days before you act contrary to this Agreement, to allow us to assess whether we may, at our sole discretion, provide an alternative remedy for the situation, though we are under no obligation to do so.
Notifications and Service Messages
For purposes of service messages and notices about the Services, FutBaller may place a banner notice across its pages to alert you to certain changes such as modifications to this Agreement. Alternatively, notice may consist of an email from FutBaller to an email address associated with your account, even if we have other contact information.
FutBaller will need to communicate with you through your FutBaller account or through other means including email, mobile number, telephone, or delivery services including the postal service about your FutBaller account or services associated with FutBaller. Please review your Account Settings to control what kind of messages you receive from FutBaller.
FutBaller Applications
This Agreement applies to FutBaller mobile applications. You also agree to certain additional information that can be shared with FutBaller. If you use a FutBaller Application or interact with a website that has deployed a plugin, you agree that information about you and your use of the Services, including, but not limited to, your device, your mobile carrier, your internet access provider, your physical location, or web pages containing FutBaller plugins that load in your browser may be communicated to us.
User-to-User Communication and Sharing
FutBaller offers various forums such as FutBaller Video Feed, Video Comments, FutBaller Challenges, FutBaller In-App Messaging, etc. where you can post your observations and comments on designated topics. FutBaller also enables sharing of information by allowing Users to post updates, including soccer-related content such as game statistics, training videos, and other content to their profile and other parts of the site.
When you share information, others can see, copy and use that information. FutBaller may close or transfer or remove content that violates this Agreement or others' intellectual property rights. Please note that ideas you post and information you share may be seen and used by other Members, and FutBaller cannot guarantee that other Members will not use the ideas and information that you share on FutBaller.
Privacy
You should carefully read our full Privacy Policy before using FutBaller as it is hereby incorporated into this Agreement by reference, and governs our treatment of any information, including personally identifiable information you submit to us.
FutBaller's Rights & Obligations
Services Availability
For as long as FutBaller continues to offer the Services, FutBaller shall provide and seek to update, improve and expand the Services. As a result, we allow you to access FutBaller as it may exist and be available on any given day and we have no other obligations, except as expressly stated in this Agreement.
Third Party Sites and Developers
FutBaller may include links to third party websites ("Third Party Sites") and applications ("Platform Applications"). You are responsible for evaluating whether you want to access or use a Third Party Site or Platform Application. You should review any applicable terms or privacy policy of a Third Party Site or Platform Application before using it or sharing any information with it, because you may give the third-party permission to use your information in ways we would not.
Updates to Terms
We reserve the right to modify, supplement, or replace the terms of this Agreement, effective upon posting at www.futballer.com or notifying you otherwise. If you do not want to agree to changes to this Agreement, you can terminate this Agreement at any time.
THIS AGREEMENT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT WAIVE YOUR RIGHT TO A COURT HEARING, RIGHT TO A JURY TRIAL, AND RIGHT TO PARTICIPATE IN A CLASS ACTION. ARBITRATION IS MANDATORY AND IS THE EXCLUSIVE REMEDY FOR ANY AND ALL DISPUTES UNLESS SPECIFIED BELOW.
Disclaimer
Some countries and jurisdictions do not permit the exclusion or limitation of implied terms in contracts with consumers. Consequently, certain provisions of this disclaimer may not apply to you.
FutBaller provides its platform and all related information, content, and services on an "as is" and "as available" basis. FutBaller and its suppliers make no guarantees, warranties, or representations regarding the accuracy, reliability, or availability of the platform or any user-generated content therein. FutBaller does not control, vet, or verify user-generated content for accuracy and is not liable for any errors or omissions arising from such content.
To the fullest extent permissible under applicable law, FutBaller and its suppliers disclaim all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, and accuracy of data.
If you are dissatisfied with FutBaller, its services, or its content, your sole and exclusive remedy is to terminate your FutBaller account in accordance with the Termination section
FutBaller is not responsible for, and makes no representations or warranties regarding, the delivery or functionality of any communications, including messages, notifications, or user-generated content sent through the platform. Furthermore, FutBaller neither warrants nor guarantees that your use of the platform will not infringe upon the rights of third parties.
Any materials, services, or technologies described or used on the platform may be subject to intellectual property rights owned by third parties who have licensed such materials, services, or technologies to FutBaller.
FutBaller has no obligation to verify the identity of individuals registering for its services or to monitor how its platform is used by members of its community. FutBaller disclaims all liability for identity theft, unauthorized account access, or any other misuse of personal information by third parties.
FutBaller does not guarantee uninterrupted or error-free operation of its services. Operations may be interrupted due to maintenance, updates, system failures, or network issues. FutBaller disclaims all liability for any interruptions, malfunctions, or errors, as well as for damages arising from such issues.
Further, FutBaller disclaims all liability for:
Malfunctions or limitations resulting from inadequate or inappropriate user equipment.
Internet service provider issues, network saturation, or other connectivity-related disturbances.
User misuse, including the violation of FutBaller’s Terms of Use, Community Guidelines, Copyright Policy, UGC Terms, or Privacy Policy.
Additional Provisions Specific to Mobile Applications:
Device and System Compatibility: FutBaller does not warrant that the platform will be compatible with all devices or operating systems. Users are responsible for ensuring their devices meet the technical requirements for accessing the platform.
Third-Party Integrations: FutBaller may integrate with third-party services. FutBaller disclaims responsibility for any actions, omissions, or liabilities arising from the use of such third-party services.
Location-Based Services: FutBaller may use location-based services to enhance functionality. Users are responsible for managing location permissions on their devices, and FutBaller disclaims liability for inaccuracies in location-based services.
Content Moderation and Monitoring: While FutBaller employs AI and human moderators to review content, it cannot guarantee the immediate removal of inappropriate content. Users should report any violations through the in-app reporting mechanisms.
Advertising and Cookies: FutBaller uses cookies and other technologies to deliver personalized advertisements. By using the platform, users consent to this data collection. However, FutBaller does not sell personal data to third parties.
Limitation of Liability:
Except where otherwise inapplicable or prohibited by law, in no event shall FutBaller or any of its officers, directors, shareholders, employees, independent contractors, telecommunications providers, and/or agents be liable for any indirect, special, incidental, exemplary, consequential, punitive, or any other damages, fees, costs or claims arising from or related to this agreement, the privacy policy, the services or products, your or a third party’s use or attempted use of the website or any software, service, or product, regardless of whether Futballer has had notice of the possibility of such damages, fees, costs, or claims. this includes, without limitation, any loss of use, loss of profits, loss of data, loss of goodwill, cost of procurement of substitute services or products, or any other indirect, special, incidental, punitive, consequential, or other damages. this applies regardless of the manner in which damages are allegedly caused, and on any theory of liability, whether for breach of contract, tort (including negligence and strict liability), warranty, or otherwise.
Neither Futballer LLC nor any of its subsidiaries, affiliated companies, suppliers, employees, shareholders, independent contractors, or directors (“FutBaller Affiliates”) shall be cumulatively liable for:
Monetary Damages:
Any damages exceeding the greater of five times the most recent fee you paid for a Premium Service, if applicable, or USD $100.
Special, Incidental, or Consequential Damages:
Any special, incidental, indirect, punitive, or consequential damages, or any loss of use, profits, revenue, or data, whether to you or any third party, arising from your use of the Services, any platform applications, or content accessed through or downloaded from FutBaller.
This limitation of liability forms an essential basis of the bargain between the parties, and absent such limitations, the terms and pricing of the Services would differ.
Application of Limitation
This limitation of liability shall apply regardless of whether:
Your claim is based on contract, tort, statute, or any other legal theory;
FutBaller knew or should have known about the possibility of such damages; or
The limited remedies provided in this section fail to achieve their essential purpose.
Compliance with Mandatory Laws:
This limitation of liability shall not limit liability in cases where applicable law prohibits such exclusions or limitations.
Dispute Resolution By Mandatory Binding Arbitration And Class Action Waiver
PLEASE READ THIS ARBITRATION PROVISION CAREFULLY TO UNDERSTAND YOUR AND YOUR BUSINESS’ RIGHTS. EXCEPT WHERE PROHIBITED BY LAW, YOU AND YOUR BUSINESS AGREE THAT ANY CLAIM THAT YOU OR YOUR BUSINESS MAY HAVE IN THE FUTURE MUST BE RESOLVED THROUGH FINAL AND BINDING CONFIDENTIAL ARBITRATION. YOU ACKNOWLEDGE AND AGREE THAT YOU AND YOUR BUSINESS ARE WAIVING THE RIGHT TO A TRIAL BY JURY. THE RIGHTS THAT YOU AND YOUR BUSINESS WOULD HAVE IF YOU WENT TO COURT, SUCH AS DISCOVERY OR THE RIGHT TO APPEAL, MAY BE MORE LIMITED OR MAY NOT EXIST. YOU AGREE THAT YOU AND YOUR BUSINESS MAY ONLY BRING A CLAIM IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF (LEAD OR OTHERWISE) OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. YOU FURTHER AGREE THAT THE ARBITRATOR MAY NOT CONSOLIDATE PROCEEDINGS OR CLAIMS OR OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
THERE IS NO JUDGE OR JURY IN ARBITRATION, AND COURT REVIEW OF AN ARBITRATION AWARD IS LIMITED. HOWEVER, AN ARBITRATOR CAN AWARD ON AN INDIVIDUAL BASIS THE SAME DAMAGES AND RELIEF AS A COURT (INCLUDING INJUNCTIVE AND DECLARATORY RELIEF OR STATUTORY DAMAGES) AND MUST FOLLOW THESE TERMS AS A COURT WOULD.
If you have a complaint, dispute, or controversy, you agree to first contact us at app@futballer.com to attempt to resolve the dispute or controversy informally. Any controversy or claim arising out of or related to the use of the Website, any product, app, service, or software, these Terms, the Privacy Policy, any affiliate agreement, or your relationship with us that cannot be resolved through such informal process or through negotiation within 120 days shall be resolved by binding, confidential arbitration administered by the American Arbitration Association (“AAA”), and judgment on the award rendered may be entered in any court having jurisdiction thereof. We agree that any claim we may have against you or your business will also be subject to this arbitration provision, except as provided in Sections 20 and 21 below. The arbitration will be conducted by a single neutral arbitrator in the English language in Wake County, North Carolina, unless we both agree to conduct the arbitration by telephone or written submissions. The arbitrator shall be selected by agreement of the parties or, if the parties cannot agree, chosen in accordance with Rules of the AAA. The arbitration will be conducted in accordance with the provisions of the AAA’s Commercial Arbitration Rules and Procedures, in effect at the time of submission of the demand for arbitration. The AAA’s Rules are available at www.adr.org or by calling 1-800-778-7879. The arbitrator shall have the exclusive and sole authority to resolve any dispute relating to the interpretation, construction, validity, applicability, or enforceability of these Terms and Conditions of Use and Sale, the Privacy Policy, this arbitration provision, and any other terms incorporated by reference into these Terms and Conditions of Use and Sale. The arbitrator shall have the exclusive and sole authority to determine whether any dispute is arbitrable. The arbitrator shall have the exclusive and sole authority to determine whether this arbitration agreement can be enforced against a non-signatory to this agreement and whether a non-signatory to this agreement can enforce this provision against you or FutBaller.
Payment of all filing, administration, and arbitrator fees will be governed by the AAA’s Rules. In all other respects, the parties shall each pay their own additional fees, costs, and expenses, including, but not limited to, those for any attorneys, experts, documents, and witnesses.
The arbitrator shall follow the substantive law of the State of North Carolina without regard to its conflicts of laws principles. Any award rendered shall include a confidential written opinion and shall be final, subject to appeal under the Federal Arbitration Act, 9 U.S.C. §§ 1-16, as amended. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
You and Futballer agree that disputes will only be arbitrated on an individual basis and shall not be consolidated, on a class wide, representative basis, or with any other arbitration(s) or other proceedings that involve any claim or controversy of any other party. You and FutBaller expressly waive any right to pursue any class or other representative action against each other.
Failure or any delay in enforcing this arbitration provision in connection with any particular claim will not constitute a waiver of any rights to require arbitration at a later time or in connection with any other claims except that all claims must be brought within 1 year after the claim arises (the 1 year period includes the 120-day informal resolution procedures described above).
This arbitration provision sets forth the terms and conditions of our agreement to final and binding confidential arbitration and is governed by and enforceable under the Federal Arbitration Act, 9 U.S.C. §§ 1-16, as amended.
This provision survives termination of your account or relationship with Futballer, bankruptcy, assignment, or transfer. If the class action waiver is deemed unenforceable (i.e., unenforceability would allow arbitration to proceed as a class or representative action), then this entire arbitration provision shall be rendered null and void and shall not apply. If a portion of this arbitration provision (other than the class action waiver) is deemed unenforceable, the remaining portions of this arbitration provision shall remain in full force and effect.
YOU UNDERSTAND THAT YOU AND YOUR BUSINESS WOULD HAVE HAD A RIGHT TO LITIGATE THROUGH A COURT, TO HAVE A JUDGE OR JURY DECIDE YOUR CASE, AND TO BE PARTY TO A CLASS OR REPRESENTATIVE ACTION. HOWEVER, YOU UNDERSTAND AND AGREE TO HAVE ANY CLAIMS DECIDED INDIVIDUALLY AND ONLY THROUGH BINDING, FINAL, AND CONFIDENTIAL ARBITRATION IN ACCORDANCE WITH THIS ARBITRATION PROVISION.
Termination
You may terminate this Agreement at any time, for any reason or no reason, by deleting your user account. Termination will take effect immediately upon the deletion of your account. Please note that FutBaller may retain a copy of the data from your closed account indefinitely and may disclose it if required by law, subpoena, or law enforcement authorities.
Similarly, FutBaller reserves the right to terminate this Agreement and your account at its discretion, with or without cause, and with or without prior notice. Such termination will become effective immediately or as specified in the termination notice. Only FutBaller or the individual or entity responsible for paying for Premium Services has the authority to terminate access to those services. Account termination includes disabling your access to the FutBaller platform and may result in your permanent exclusion from future use of the platform.
FutBaller also retains the right to restrict, suspend, or terminate the account of any user found to be engaging in abusive activities or violating the terms of this Agreement. Misuse of the Services includes, but is not limited to:
Sending unsolicited invitations to connect with individuals you do not know;
Exploiting messaging services for inappropriate or unauthorized purposes;
Creating false or duplicate profiles;
Using the Services for commercial purposes without prior authorization;
Infringing on intellectual property rights;
Violating any rules in this Agreement or the Community Service Guidelines.
In addition, FutBaller may, at its sole discretion, terminate the accounts of users it identifies as repeat infringers under the United States Copyright Act or other applicable laws.
Upon termination of your account, you will lose access to all FutBaller Services, including any data or features associated with your account. While most provisions of this Agreement will remain in effect following termination, any specific rights you held under this Agreement will no longer apply.
