All software, design, branding, trademarks, and content created or licensed by FutBaller (including logos, user interfaces, and proprietary algorithms) remain the sole property of FutBaller, Inc. These materials are protected by copyright, trademark, and other intellectual property laws.

1.2 User-Generated Content (UGC)  

Users retain ownership of the original videos, images, and other content they upload to the platform. However, by uploading content to FutBaller, users grant FutBaller a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, display, distribute, modify, and create derivative works of the content as necessary for operating, promoting, and improving the platform. This license ends when the user deletes the content or their account, except for content that:  

  1. Has been shared with other users who have not deleted it.  

  2. FutBaller has already used in marketing, promotions, or other platform functions in reliance on this license.  

Users are responsible for ensuring that they have the necessary rights and permissions to upload and share content on the platform.

2. User-Generated Content and Copyrighted Material  

2.1 Uploading Copyrighted Content  

Users may not upload or share content that infringes on the intellectual property rights of others. This includes, but is not limited to:  

  1. Using music, images, or video clips that are copyrighted and for which the user does not have proper licenses or permissions.  

  2. Uploading game footage or team photos without the consent of the individuals or teams featured.  

FutBaller employs automated tools and manual reviews to detect potentially infringing content. However, users are ultimately responsible for ensuring their uploads comply with copyright laws.

2.2 Music and Third-Party Content  

If a user uploads a video that includes music or other third-party copyrighted material, they must ensure that they have the appropriate license or rights to use that material.  

  1. Licensed Music: Users must provide proof of proper licensing upon request.  

  2. Unauthorized Music or Content: Videos containing unlicensed music or other copyrighted materials may be removed or muted in compliance with applicable copyright laws.  

FutBaller encourages users to utilize music libraries that provide royalty-free or properly licensed music. The platform may also integrate with music licensing partners to simplify the selection of compliant tracks for users.


3. Reporting Copyright Violations  

3.1 Filing a DMCA Takedown Notice  

FutBaller complies with the Digital Millennium Copyright Act (DMCA) and provides a mechanism for copyright owners to report infringing content. If you believe your copyrighted work has been used without authorization, please submit a written notice containing:  

  1. A description of the copyrighted work that you claim has been infringed.  

  2. The URL or other identifying information about the infringing content.

3.2 Counter-Notification  

If you believe that content you uploaded was removed in error, you may submit a counter-notification containing:

  3. Your name, address, phone number, and email address.  

  4. A statement that you consent to the jurisdiction of the federal court in your district and agree to accept service of process from the complainant.  

  5. Your electronic or physical signature.  

Upon receipt of a valid counter-notification, FutBaller may reinstate the content unless the complainant files legal action within 10 business days.

4. Misuse of Copyright Protections  

FutBaller strictly prohibits the unauthorized use of copyrighted materials on its platform. This includes, but is not limited to, music, images, video clips, logos, trademarks, and other intellectual property for which the user does not have the necessary rights or permissions. Users are solely responsible for ensuring that their uploaded content complies with applicable copyright laws. Any content containing unauthorized use of copyrighted material, such as unlicensed music or third-party branding, will be removed immediately upon detection or notification. In cases of repeated or deliberate infringement, users may face account suspension or termination.

Users are advised to use royalty-free music or tracks for which they have obtained proper licensing. To simplify compliance, FutBaller provides access to a curated library of licensed music that users can incorporate into their videos. Any videos found to contain unlicensed or infringing music may be muted or removed from the platform. Repeat violations of this policy may result in enforcement actions, including the suspension of user accounts.

FutBaller enforces copyright compliance through a combination of automated systems and human moderation. Advanced AI tools analyze uploaded content for potential copyright violations by detecting audio, visual, and metadata elements that may correspond to protected works. The appeals process requires users to provide a detailed description of the removed content, an explanation of why the content complies with copyright laws, and any supporting documentation, such as licenses or proof of ownership. FutBaller’s moderation team reviews all appeals and communicates its decisions within ten business days. If the appeal is found to have merit, the content may be reinstated.

5. Repeat Infringers  

FutBaller maintains a zero-tolerance policy for repeat infringers. Accounts associated with multiple valid copyright violations will be permanently banned in accordance with the United States Copyright Act.
